Terms of Service.
The terms governing your use of totalcms.co, your Total CMS 3 account, and purchases made through the store. For the software license itself, see the EULA.
Acceptance of Terms
By accessing totalcms.co, downloading Total CMS, or purchasing a license, you agree to these Terms of Service. If you don't agree, don't use the site or software.
Use of the Website
totalcms.co is provided to help you evaluate, download, and license Total CMS. You agree not to misuse the site — including attempting to disrupt it, scrape it abusively, or access parts of it you're not authorized to access.
Accounts
Your Total CMS admin account lives on your own installation, not on totalcms.co — we don't host or manage it. Some services referenced from this site (the community forum, support) have their own accounts, managed by weavers.space under their own terms.
Purchases
Total CMS licenses and upgrades are purchased through the built-in store in your admin dashboard, not directly on totalcms.co. Purchases are one-time, per domain. Licenses are purchased per domain; what a license includes — updates, renewals, and transfers — is set out in the End User License Agreement.
Free Trial
Total CMS offers a free 45-day trial for evaluation. During the trial you get full access to Pro-tier features on the domain you register. No payment details are required to start.
When the trial ends, license validation and software updates stop, but the software itself keeps running — we don't remotely disable installations or delete content. To continue receiving updates and validation, purchase a license through the store in your admin dashboard.
Trials are for evaluation. Running a production site indefinitely on trial installations isn't permitted, and we may decline to issue repeated trials for the same domain or user.
Refunds
Because the free 45-day trial provides full access to evaluate Total CMS before purchase, all license sales are final. We encourage you to complete your evaluation during the trial before buying.
If something has gone wrong with a purchase — a duplicate charge, a licensing error, a purchase for the wrong domain — contact us and we'll make it right. Nothing in this policy limits any non-waivable statutory rights you may have under the laws of your jurisdiction.
Acceptable Use
When using Total CMS or totalcms.co, you agree not to:
- Violate any applicable law or regulation
- Circumvent or attempt to circumvent license validation except as expressly permitted by us (for example, offline licensing arrangements)
- Redistribute, resell, or sublicense the software except as permitted by the EULA
- Use the software or site to distribute malware or engage in fraudulent activity
Intellectual Property
Total CMS, its source code, documentation, and the totalcms.co website are the property of Aspect Services, LLC and its licensors. Your license grants you rights to use the software as described in the EULA; it does not transfer ownership.
Third-Party Services & Links
The community forum and support ticketing are provided by a third party, weavers.space. Accounts, posts, and support conversations there are governed by weavers.space's own privacy policy, not this one.
Disclaimer of Warranties
totalcms.co and Total CMS are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. See the EULA for the software-specific warranty disclaimer.
Licenses include access to community-based support through the forum and our support channels. We work hard to help, but response times and resolutions aren't guaranteed except under a separate written agreement (for example, enterprise support terms).
Limitation of Liability
To the fullest extent permitted by law, Aspect Services, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of totalcms.co or Total CMS, even if advised of the possibility of such damages.
Termination
We may suspend or terminate your access to totalcms.co and its connected services — including license validation, updates, and the in-dashboard store — if you materially breach these terms and, where the breach is curable, fail to cure it within 30 days of notice.
Termination of a software license is governed by the EULA. Suspension or termination of website access does not, by itself, revoke a validly purchased license: because Total CMS runs on your own server, your installation and your content remain yours and under your control.
If we ever discontinue totalcms.co or its services, validly purchased licenses survive, and we'll make reasonable efforts to provide offline validation or equivalent arrangements so existing installations can continue operating.
Governing Law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Changes to These Terms
We may update these terms from time to time. Continued use of totalcms.co or the software after a change constitutes acceptance of the updated terms.
